These Terms & Conditions ("Terms") govern your use of services provided by Moe Customs ("we," "us"). By scheduling, paying for, or receiving any service, you ("Customer") agree to be bound by these Terms.
1. Estimates
All written and verbal estimates are preliminary and subject to change following in-person inspection of the vehicle. Final pricing may vary based on vehicle condition, pre-existing damage, additional preparation required, or scope changes requested by Customer.
2. Deposits & Payment
A non-refundable deposit may be required to secure an appointment. Remaining balances are due upon completion of service and prior to vehicle release. We accept cash, major credit cards, ACH, and approved financing. Returned payments are subject to a $50 fee plus collection costs.
3. Cancellations & Rescheduling
Cancellations made more than 72 hours before the scheduled appointment may receive a deposit refund less a $100 administrative fee. Cancellations within 72 hours forfeit the deposit. Rescheduling is permitted once at no cost; additional reschedules may incur fees.
4. Vehicle Condition & Pre-Existing Damage
Customer represents that the vehicle is in roadworthy condition and that Customer is the legal owner or authorized to commission services. Moe Customs documents the vehicle's condition prior to service and is not responsible for pre-existing damage, mechanical defects, or paint conditions disclosed or evident at intake.
5. Customer-Provided Information & Materials
If Customer provides materials, films, designs, or specifications, Customer warrants their suitability and accuracy. Moe Customs is not liable for results stemming from defective customer-provided materials or inaccurate information.
6. Service Limitations
- Wraps and films cannot conceal all paint imperfections; some may telegraph through.
- Edge wrapping is performed where practical; some panels are limited by design.
- Color matching across multi-piece installations is approximate.
- Vehicle electronics, sensors, and antennas may require recalibration after service.
7. Warranties
Manufacturer warranties apply to the films and coatings installed. Installation labor is warranted against defects in workmanship for a period stated in your Service Agreement. Warranties do not cover damage from accidents, abuse, improper care, automatic carwashes, abrasive chemicals, modifications, or normal wear.
8. Vehicle Storage
Vehicles not picked up within seven (7) days of completion may be subject to storage fees of $50/day. Vehicles unclaimed after 30 days may be subject to mechanic's lien proceedings under Florida law.
9. Photo & Media Use
Customer grants Moe Customs the right to photograph and use images of the vehicle for marketing, with personal identifiers obscured where reasonably practicable. Customer may opt out in writing at the time of service.
10. Limitation of Liability
To the maximum extent permitted by law, Moe Customs' total liability shall not exceed the amount paid by Customer for the specific service at issue. Moe Customs is not liable for indirect, incidental, consequential, or punitive damages, including lost time, diminished value, or rental costs.
11. Force Majeure
We are not liable for delays or failures caused by events beyond reasonable control, including hurricanes, supply chain disruptions, utility outages, governmental orders, pandemics, or material shortages.
12. Dispute Resolution
Any dispute arising from these Terms or services rendered shall be resolved exclusively through binding arbitration in Palm Beach County, Florida, under the rules of the American Arbitration Association. Both parties waive class action rights. Florida law governs.
13. Severability & Entire Agreement
If any provision is held unenforceable, the remainder remains in effect. These Terms, together with the Service Agreement, Liability Waiver, and Privacy Policy, constitute the entire agreement between the parties.
