By engaging Moe Customs for any service, Customer acknowledges and agrees to the following release of liability.
1. Acknowledgment of Risks
Customer acknowledges that automotive customization, film application, paint correction, and coating services involve inherent risks including but not limited to: minor surface scratches during preparation, paint imperfections becoming visible after film removal, adhesive residue, edge lift over time, color variations, and the possibility that pre-existing paint defects or aftermarket repairs may be revealed or aggravated during service.
2. Vehicle Condition
Customer represents that the vehicle's paint, glass, and surfaces are in suitable condition for the requested service. Customer agrees to disclose any prior bodywork, repaints, blendings, or known defects. Failure to disclose may void warranty coverage.
3. Release of Claims
Customer hereby releases, discharges, and holds harmless Moe Customs, its owners, employees, contractors, and agents from any and all claims, demands, damages, costs, or causes of action arising from or related to: (a) cosmetic outcomes inherent to the application of films, wraps, or coatings; (b) pre-existing damage or paint conditions exposed or worsened during service; (c) reasonable wear during installation; (d) software or sensor recalibration needs following service; and (e) circumstances beyond reasonable control of Moe Customs.
4. Assumption of Risk
Customer voluntarily assumes all risks associated with leaving the vehicle in our possession for the duration of service, including reasonable risks of incidental damage that may occur during normal shop operations not amounting to negligence.
5. Insurance
Moe Customs maintains commercial general liability and garage-keepers insurance. Coverage limits are available upon written request.
6. Indemnification
Customer agrees to indemnify and hold Moe Customs harmless from claims arising out of Customer's misrepresentation of vehicle ownership, condition, or authority to commission services.
7. Voluntary & Informed Consent
Customer affirms they have read this Waiver, understand its terms, have had the opportunity to ask questions, and execute it voluntarily.
8. Governing Law
This Waiver is governed by Florida law. Any disputes are subject to the dispute resolution provisions of the Moe Customs Terms & Conditions.
